Caveman Cigar Company Terms and Conditions

1. Acceptance of Terms

By accessing or using the website of Caveman Cigar Company (cavemancigars.biz), you agree to be bound by these Terms and Conditions ("Terms"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Age Restriction & Compliance with Tobacco 21 Laws

  • Minimum Age: You must be at least 21 years of age to purchase, possess, or consume tobacco products. By agreeing to these Terms, you represent that you are at least 21 years old and are not allowing anyone under 21 years of age to access or use our services through your account.

  • Age Verification: In compliance with federal and Texas state laws, we use a commercially available database to verify the age and identity of all first-time purchasers. You may be required to provide a copy of a government-issued photo ID (driver's license, passport, or military ID) to confirm your age.

  • No Exceptions: The federal minimum age of 21 applies to all retail sales of tobacco products, including cigars, with no exceptions (e.g., for military personnel under 21).

  • Penalties: Falsifying your age or identification to purchase tobacco products is a Class C misdemeanor in Texas, punishable by a fine of up to $500.

3. Product Information and Limitations

  • Product Types: We sell premium cigars. Note that new Texas laws effective September 1, 2025, have banned the sale of most disposable e-cigarettes, vapes containing cannabinoids (including CBD/Delta-8), and vapes manufactured in China. These items are not offered.

  • Health Warnings: All tobacco products and advertisements feature required health warning statements.

  • No Free Samples/Coupons: Federal and state law prohibits the free distribution of tobacco products or coupons for free/discounted products to consumers.

4. Shipping and Delivery (PACT Act Compliance)

  • Adult Signature Required: All shipments of tobacco products require the use of a delivery service that obtains the signature and verifies the government-issued photo ID of an adult (age 21 or older) at the delivery address.

  • State Restrictions: We only ship to states where the online sale of cigars is permitted. We reserve the right to limit or refuse sales to certain states.

  • Taxes: Applicable state and local sales taxes will be collected and remitted as required by law.

5. Returns and Exchanges

  • Defective Items: Only defective cigars may be returned or exchanged within 30 days of purchase. They must be returned in their original packaging.

  • Conditions: We do not accept returns of cut or smoked cigars. Proof of purchase is required for all returns.

6. Limitation of Liability and Disclaimer

Caveman Cigar Company is not liable for any damages arising from the use or inability to use the materials on this website, even if we or an authorized representative have been notified orally or in writing of the possibility of such damage.

7. Governing Law and Dispute Resolution

These terms and conditions are governed by and construed in accordance with the laws of the State of Texas and federal law. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Washington County, Texas.
